of Alma Park Gelsenkirchen

General Terms and Conditions

of Alma-Park GmbH, Almastraße 39, 45886 Gelsenkirchen, Germany

Last updated: 17 August 2026

1. Basis of the contract

1.1 Scope

These General Terms and Conditions apply to all contracts between Alma-Park GmbH, Almastraße 39, 45886 Gelsenkirchen, Germany (hereinafter “Alma Park”), and its customers, members and other users, unless otherwise agreed in an individual case.

They apply in particular to the use of Alma Park’s facilities, leisure activities, events, food and drink services and other services.

The services offered include in particular:

  • Laser Tag

  • Karting

  • Poolball

  • Football

  • Paintball

  • Escape rooms

  • Arrowtag

  • Bubbleball

  • Mini Golf

  • Trampoline Park

  • Axe Throwing

  • Pixel Games

  • Virtual Reality

  • Sports bar and food and drink

  • Children's birthday parties

  • School group packages

  • Company events

  • Stag and hen parties

  • Group events

  • Action Passes and other combination packages

The current service description for the product booked forms part of the contract.

The customer’s own terms of business or contractual terms do not apply unless Alma Park has expressly agreed to their application.

Alma Park may temporarily or permanently change, replace, restrict or discontinue facilities, activities, operating areas, game procedures, opening hours and conditions of use for objectively justified reasons.

Objectively justified reasons include, in particular, safety requirements, technical or structural reasons, maintenance and repair work, official requirements, changes in legal requirements, staff absences, lack of availability of spare parts or operating materials, events and other operational needs.

For services already booked, the agreed essential characteristics of the service remain binding. Temporary restrictions affecting individual facilities or activities are permissible provided they do not materially impair the overall service booked.

There is no entitlement to the continued existence of any particular attraction or facility for future bookings.

1.2 Formation of the contract

The presentation of services, products, prices and available dates on Alma Park’s websites, in booking systems, price lists, advertising materials or other media does not, as a rule, constitute a binding contractual offer.

By completing a booking, the customer submits a binding offer to enter into the relevant contract.

The contract is formed when Alma Park expressly confirms the booking, when an automated booking confirmation identified as such is issued, or at the latest when performance of the service begins.

A purely technical acknowledgement of receipt does not constitute acceptance unless it is expressly identified as a booking confirmation.

Until acceptance, Alma Park may reject booking requests, in particular because of insufficient capacity, technical or organisational reasons, safety requirements or other operational reasons.

Unless expressly agreed otherwise, the full booking price is payable when the contract is formed.

Alma Park may refuse access to booked services until payment has been made in full.

Alma Park may require a suitable official photographic identity document to establish identity or verify age, eligibility to participate or entitlement to admission.

If the required evidence is not provided, access to the relevant activity may be refused. There is no entitlement to a refund if the customer was informed of the relevant requirement when booking or if it is stated in the service description or conditions of use.

Discounts, vouchers, special prices, promotional codes, membership benefits and other concessions may only be combined if this is expressly stated or confirmed by Alma Park.

1.3 Membership accounts and access credentials

Where users receive a customer account, membership account, password, membership card or other personal access credentials, these must be kept safe and protected against access by third parties.

Any loss or suspected misuse must be reported to Alma Park without delay.

Alma Park may temporarily block access credentials or membership cards if misuse is suspected.

1.4 Minors

Specific age, height, weight or other participation requirements apply to individual activities.

Minors may only use services in accordance with the requirements applicable to the relevant activity and with any necessary consent from, or accompaniment by, a parent, legal guardian or supervising adult.

Alma Park may require suitable proof of age.

Participation may be refused if any required proof of age, consent or other evidence cannot be provided.

The responsible accompanying or supervising person remains responsible for fulfilling their statutory duty of supervision.

1.5 Cancellations, non-attendance and participant numbers

Unless different cancellation terms have been agreed for a service or specified when booking, Alma Park voluntarily allows customers to cancel a booking free of charge up to 72 hours before the agreed start time.

Cancellation must be made in text form, in particular by email, or using a cancellation function provided by Alma Park for this purpose.

The time at which Alma Park receives the cancellation determines whether the deadline has been met.

Once the applicable free cancellation period has expired, there is generally no contractual entitlement to cancel, change or reduce a booking free of charge.

In the event of a later cancellation or non-attendance, the agreed booking price generally remains payable.

The customer expressly retains the right to demonstrate that Alma Park has suffered no loss or a substantially lower loss. Any expenses saved or alternative use of the reserved capacity that must be taken into account by law will be credited accordingly.

A reduction in the number of participants booked generally constitutes a partial cancellation. If made after the applicable free cancellation period has expired, it does not generally reduce the agreed booking price.

The number of participants may only be increased with Alma Park’s prior consent and subject to available capacity.

Additional participants will be charged at the agreed prices or the prices applicable at the time of the change.

Different cancellation and amendment terms may be agreed for groups, events, business customers, special events or individually prepared offers. These take precedence over the general provisions of this clause.

Any goodwill arrangements offered by Alma Park are voluntary and apply solely to the individual case concerned. Repeated goodwill arrangements do not create an entitlement to similar treatment in future or comparable cases.

1.6 No right of withdrawal for leisure services on specified dates

Under section 312g(2), point 9 of the German Civil Code (BGB), there is no statutory right of withdrawal from contracts for services relating to leisure activities where a specific date or period is provided for their performance.

This applies in particular to bookings for leisure activities, Action Passes, group packages, children’s birthday parties, company events, other events and other services tied to a specific date.

Any cancellation or rebooking options voluntarily offered by Alma Park do not constitute a statutory right of withdrawal.

1.7 Retention of title

Goods sold by Alma Park remain Alma Park’s property until payment has been made in full.

1.8 Technical errors, booking errors and unavailability

Alma Park may reject or cancel a booking if it arose as a result of a technical error, system error, obvious pricing or input error, incorrect availability information, double booking or other unavailability that was not foreseeable when the contract was formed, and fulfilling the booking is impossible or unreasonable for Alma Park.

Alma Park will inform the customer without delay.

Any payment already made for a service that is consequently not provided will be refunded without delay.

Any further claims are governed by statutory provisions and the liability provisions of these Terms and Conditions.

2. Use of the facilities

2.1 House rules and specific conditions of use

Alma Park may establish house rules, safety rules and specific conditions of use for the entire premises and for individual facilities, activities and areas.

These may include, in particular, rules on safety, clothing, footwear, protective equipment, conduct, game procedures, age, height or weight restrictions, and the protection of other users and staff.

All users must comply with the applicable house rules, safety rules and conditions of use.

2.2 Authority to give instructions

Alma Park staff may give any instructions necessary to maintain orderly and safe operations.

Staff instructions must be followed.

In the event of breaches of safety rules, house rules or staff instructions, or conduct that endangers other people or facilities, Alma Park may temporarily or permanently prohibit participation in individual activities or any further stay at Alma Park.

If exclusion results from conduct for which the user is responsible, there is generally no entitlement to a refund of the admission or booking price.

Any further claims by Alma Park remain unaffected.

2.3 Payment methods

Alma Park may specify particular payment methods or exclude individual payment methods for some or all facilities.

There is no entitlement to use a particular payment method.

2.4 Scope of services and use of the Action Pass

During the booked period of use, the Action Pass entitles the holder to use the activities included in the relevant product description, subject to available capacity, operational availability and the applicable conditions of use.

The Action Pass is a time-limited combination package comprising various leisure activities. The individual activities included are generally components of the overall package and, unless expressly agreed otherwise, do not constitute separately guaranteed services.

Use of an activity requires compliance with all age, height, weight, safety, clothing, equipment and other participation requirements applicable to that activity.

If a user does not meet these requirements, they are not entitled to use the activity concerned and are generally not entitled to a proportional refund of the Action Pass price.

In particular, the Action Pass does not confer any entitlement to:

  • actually use every activity included;

  • use a particular activity at a particular time;

  • complete every activity once in full within the booked period;

  • use the activities in a particular order;

  • use individual activities more than once;

  • complete a particular minimum number of rides, games, rounds or sessions;

  • receive a particular playing or driving time for any individual activity;

  • gain access to an activity without waiting; or

  • use a particular attraction exclusively or only with members of one’s own group.

All activities are subject to availability and capacity.

Waiting times may arise, particularly during busy periods.

Waiting times and any necessary briefing, safety, changing, transfer, preparation and equipment set-up time form part of the visit and do not generally extend the booked period of use.

Users are responsible for planning their available time, taking into account possible waiting times and the activities they wish to use.

Any unused or partially used time expires at the end of the booked time slot.

A customer’s late arrival does not generally postpone or extend the booked period of use and does not give rise to an entitlement to a full or partial refund.

Voluntarily ending a visit early or choosing not to use individual activities does not generally give rise to an entitlement to a refund.

Availability of attractions and restrictions on services

There is no entitlement to the unrestricted and continuous availability of every attraction included in the Action Pass.

Individual attractions, facilities or areas may be temporarily restricted, changed or closed entirely, in particular because of safety measures, maintenance or repair work, technical faults, software or system problems, necessary updates, official orders, staff absences, capacity management, events or other objectively justified operational needs.

Temporary restrictions or unavailability affecting individual attractions do not generally give rise to an entitlement to a full or partial refund, price reduction, extension of the period of use, substitute service, voucher or other compensation, provided the Action Pass as a whole can still be used in a reasonable manner and a substantial part of the agreed leisure offering remains available.

This also generally applies where the user personally considered a particular attraction to be the main reason for their visit, unless the availability of that attraction was expressly guaranteed as an essential or sole contractual service.

Merely naming or presenting an attraction as part of a combination package does not guarantee its uninterrupted or continuous availability throughout the visit.

The customer’s statutory rights remain unaffected if use of the Action Pass as a whole in accordance with the contract is materially impaired or becomes impossible.

Additional services, upgrades, consumables, mandatory personal equipment and other chargeable services not included in the Action Pass booked must be paid for separately, unless expressly stated otherwise.

2.5 Interruptions to individual activities

Alma Park may temporarily interrupt an activity in progress at any time for safety, technical or operational reasons.

Brief interruptions do not generally give rise to an entitlement to a refund, extension or repeat session.

If a specific activity booked individually cannot take place at all because of a disruption for which the user is not responsible, the statutory provisions apply.

2.6 Participation requirements and personal suitability

Users may only participate in activities if they meet the relevant participation requirements and their physical or mental condition does not create any identifiable risk to themselves or others.

People who are visibly under the influence of alcohol, drugs or other intoxicating substances, or whose safe participation appears doubtful for other reasons, may be excluded from individual activities or from use of the facilities altogether.

If exclusion is based on circumstances within the user’s sphere of responsibility, there is generally no entitlement to a refund.

The responsible staff will decide on exclusion for safety reasons, exercising their discretion properly.

2.7 Group bookings

For group bookings, the customer making the booking or the person acting on behalf of the group must inform the other participants in good time of all information material to the booking, in particular the safety, age, participation, cancellation and usage conditions.

The person making the booking is not authorised to promise other participants any additional services on Alma Park’s behalf.

3. Users’ obligations

3.1 Handling access credentials and membership cards

Users must keep membership cards, access credentials, passwords and comparable authorisations safe.

Any loss or misuse must be reported to Alma Park without delay.

3.2 Replacement membership cards

An activation or replacement fee may be charged for the initial issue of a membership card and for any replacement required following loss or damage for which the user is responsible, in accordance with the price list agreed when the contract was formed.

3.3 Sharing membership cards and access credentials

Memberships, personalised tickets, access credentials and other expressly personal usage authorisations are non-transferable.

They may only be used by the person entitled to use them.

In the event of culpable misuse through unauthorised sharing or use, Alma Park may claim compensation for the resulting loss and block the relevant usage authorisation.

Where a fixed amount of compensation has been agreed for this purpose, the user retains the right to demonstrate that no loss or a substantially lower loss was incurred.

Alma Park retains the right to demonstrate that the actual loss incurred was higher.

3.4 Changes to customer details

Users must promptly notify Alma Park of changes to their details relevant to the contract, in particular their name, address, email address and payment details, insofar as these are necessary to perform the contract.

Costs incurred by Alma Park as a result of a user’s culpable failure to provide notice, or delay in doing so, may be charged to the user in the amount actually incurred.

Personal data is processed in accordance with Alma Park’s applicable privacy notice.

3.5 Use of lockers

Lockers provided by Alma Park may generally only be used during the relevant visit.

After the end of the operating day, or if a locker is used beyond the permitted period, Alma Park may open and empty it.

Items left behind will be treated as lost property.

Providing a locker does not create a safekeeping agreement unless expressly agreed otherwise.

3.6 Use of customer parking spaces

Customer parking spaces may generally only be used in connection with a visit to, or authorised use of, Alma Park.

Within the limits of the law, Alma Park may arrange for vehicles parked without authorisation or contrary to the posted conditions to be removed at the responsible person’s expense.

Parking a vehicle does not create a guarding or safekeeping agreement.

3.7 Marketing and advertising

All users acknowledge that Alma Park also advertises and carries out marketing through electronic media. By participating in activities at the facilities, users expressly consent to photographs and video recordings of them being made in this connection and used for advertising purposes. Users who object to such recordings must expressly notify Alma Park before using the facility.

3.8 Damage and soiling

Alma Park’s facilities, equipment and other property must be treated with care and used solely for their intended purpose.

Anyone who culpably causes damage or exceptional soiling is liable in accordance with statutory provisions.

Alma Park may claim the necessary repair, replacement, cleaning and other consequential costs.

4. Prices, payment and late payment

4.1 Admission and booking prices

Unless agreed otherwise, the agreed admission or booking price is payable when the contract is formed.

Alma Park may require deposits, advance payments or full payment in advance for certain services.

Participation or admission may be refused until payment has been made in full.

4.2 Membership fees

Membership fees are payable monthly in advance unless the contract provides otherwise.

The fee for the first partial calendar month and any agreed activation fees are due at the start of the contract.

4.3 Prices and price adjustments

Alma Park may change prices, rates, additional services, packages, discounts and the structure of its offers at any time for future bookings.

For individual bookings that have already become binding, the price agreed when the contract was formed generally applies.

For continuing contractual relationships and memberships, Alma Park may adjust future fees if the overall costs relevant to pricing change after the contract is formed.

These include, in particular, staffing, energy, rent, operating, insurance, maintenance, repair, licensing, IT, tax and levy costs.

Any adjustment may only reflect the change in the overall costs relevant to the service. Cost reductions must also be taken into account in the calculation.

Alma Park will inform the user in good time before any such price change takes effect.

The user’s mandatory statutory rights remain unaffected.

4.4 Changes to VAT and statutory levies

If statutory VAT changes, or comparable mandatory public levies are introduced or changed, Alma Park may adjust the agreed charges accordingly to the extent permitted by law.

4.5 Reversed payments

Users must ensure that any account provided for direct debits has sufficient funds at the time of collection and that the payment details provided are correct.

If a returned direct debit or failed payment for which the user is responsible causes additional costs, Alma Park may charge the user the necessary costs actually incurred.

4.6 Additional services

The admission, membership or booking price includes only the services expressly listed in the relevant product description.

Additional products, consumables, upgrades, food, drinks, equipment and other additional services may be charged separately.

4.7 Late payment

Statutory provisions apply in the event of late payment.

In particular, Alma Park may claim statutory default interest and the necessary costs of appropriate legal action to recover payment.

If a member is in arrears by an amount equal to at least two monthly membership fees, this may constitute good cause for extraordinary termination.

Until outstanding amounts have been paid, Alma Park may refuse further services or suspend memberships or access authorisations to the extent permitted by law.

4.8 Dispute resolution proceedings

Alma-Park GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body unless participation is required by law.

Statutory duties to provide information after a specific consumer dispute has arisen remain unaffected.

4.9 Vouchers and promotional vouchers

Vouchers purchased for payment are subject to the conditions stated at the time of purchase and the statutory limitation periods.

The value of a voucher cannot be paid out in cash unless there is a statutory entitlement to such payment.

Promotional, discount and free vouchers may be restricted by time, product, date, group of people or minimum booking value.

Promotional vouchers may expire without replacement at the end of the stated promotional period, provided this was communicated transparently when they were issued.

Multiple vouchers, discount codes or promotions may only be combined where this is expressly permitted.

5. Memberships

5.1 Contract term and termination

Unless a different term has been expressly agreed, membership contracts initially run for twelve months.

One month’s notice is required to terminate the contract at the end of the initial term.

If the contract is not terminated within the notice period, it continues for an indefinite period after the initial term ends.

Once the contract has continued for an indefinite period, it may be terminated at any time on one month’s notice.

Notice of termination may be given in text form.

Where Alma Park is legally required to provide an electronic termination facility for continuing contractual relationships that can be entered into online, notice of termination may also be submitted using that facility.

Both parties’ right to extraordinary termination for good cause remains unaffected.

5.2 Extraordinary termination

Either party may terminate the contract for good cause without observing the ordinary notice period.

Good cause for Alma Park may arise in particular in the event of:

  • serious or repeated breaches of safety rules or house rules;

  • intentional damage to facilities;

  • physical assaults, threats or serious insults directed at staff or other guests;

  • misuse through unauthorised sharing of personalised access authorisations;

  • substantial payment arrears; or

  • other conduct that makes it unreasonable to expect Alma Park to continue the contract.

Any statutory requirements to issue warnings or set deadlines remain unaffected.

6. Alma Park’s liability

6.1 General liability

Alma Park is liable without limitation for loss or damage resulting from an intentional or grossly negligent breach of duty by Alma Park, its legal representatives or persons it engages to perform its obligations.

Alma Park is also liable without limitation for loss or damage resulting from death, personal injury or damage to health insofar as this results from a culpable breach of duty by Alma Park, its legal representatives or persons it engages to perform its obligations.

In the event of a slightly negligent breach of essential contractual obligations, Alma Park’s liability is limited to the loss or damage that was foreseeable when the contract was formed and is typical of the contract.

Essential contractual obligations are those whose fulfilment is necessary for proper performance of the contract and on whose observance the customer may ordinarily rely.

In all other respects, Alma Park’s liability for loss or damage caused by slight negligence is excluded.

The above limitations of liability also apply for the benefit of Alma Park’s legal representatives, staff and persons it engages to perform its obligations.

Liability under mandatory statutory provisions, in particular the German Product Liability Act, remains unaffected.

6.2 Risks inherent in activities

Taking part in sporting and leisure activities may involve risks inherent in those activities.

Alma Park is not liable for loss or damage caused solely by the occurrence of such a general or activity-specific risk, where it does not result from a culpable breach of duty by Alma Park, its legal representatives or persons it engages to perform its obligations.

Users must follow the safety information, briefings and staff instructions and correctly use the safety equipment provided or required.

6.3 Personal belongings

Alma Park generally assumes no obligation to keep users’ clothing, mobile phones, cash, jewellery, valuables or other personal property safe.

This also applies when cloakrooms, storage areas or lockers are used, unless a separate safekeeping agreement has been expressly concluded.

Alma Park’s liability in these cases is also governed by the provisions of this section.

6.4 Damage caused between users

Alma Park is not liable for loss or damage caused by one user to another unless Alma Park is itself responsible for a culpable breach of duty.

7. Conduct on the premises

7.1 Alcohol, drugs and dangerous conduct

Smoking is permitted only in designated areas.

The consumption or possession of illegal drugs and other prohibited intoxicating substances is forbidden on Alma Park’s premises.

Alcohol may only be consumed in the areas designated for this purpose and to the extent permitted by Alma Park.

Participation in activities while impaired to an extent that prevents safe use is prohibited.

Where there are grounds for such suspicion, Alma Park may exclude people from activities or require them to leave the premises.

Bringing weapons or other objects that, by their nature or use, could endanger people is prohibited unless they are expressly part of an activity offered and supervised by Alma Park.

In the event of serious or repeated breaches, Alma Park may exclude the user from further use, ban them from the premises and terminate existing contractual relationships for good cause, subject to the statutory requirements.

If exclusion results from culpable conduct by the user, there is generally no entitlement to a refund of fees already paid.

Any further claims for damages by Alma Park remain unaffected.

7.2 Animals and assistance dogs

Animals are generally not permitted in Alma Park’s buildings, halls and activity areas.

Statutory access rights for recognised assistance dogs remain unaffected.

Access to individual areas where safety is critical may be restricted insofar as this is necessary to protect people or animals and is permitted by law.

7.3 Conduct towards staff and other guests

Users must behave in a way that neither endangers nor unreasonably inconveniences staff, other guests or other people.

In particular, physical assaults, threats, serious insults, intentional disruption of operations, tampering with technical equipment or repeated disregard of safety instructions may result in immediate exclusion from use and a ban from the premises.

Where exclusion is attributable to the user, there is generally no entitlement to a refund.

8. Final provisions

8.1 Changes to these Terms and Conditions

Alma Park may amend these General Terms and Conditions at any time with effect for future contracts.

For existing continuing contractual relationships, changes may be made where there is an objective reason and the balance between performance and consideration established when the contract was formed is not unreasonably altered to the user’s disadvantage.

An objective reason may arise in particular from changes in legislation, rulings of the highest courts, official requirements, technical processes, booking, safety or payment systems, or comparable operational changes.

Where the customer’s consent to a change is required by law, it will be obtained separately.

8.2 Set-off, rights of retention and assignment

The user may set off claims against Alma Park’s claims where the counterclaims are undisputed, have been established by a final judgment or are ready for judicial determination.

Mandatory statutory rights of set-off remain unaffected.

Rights of retention may only be exercised in respect of counterclaims arising from the same contractual relationship, insofar as permitted by law.

The assignment of the user’s non-monetary claims requires Alma Park’s prior consent insofar as Alma Park has a legitimate interest in prohibiting assignment and the user’s legitimate interests in assignment do not outweigh it.

The assignment of monetary claims remains permissible to the extent provided by law.

8.3 References to people

All references to people in these Terms and Conditions apply equally to all genders.

Any particular linguistic form is used solely to improve readability.

8.4 Applicable law, place of performance and jurisdiction

The law of the Federal Republic of Germany applies.

For consumers, this choice of law applies only insofar as it does not restrict the protection afforded by mandatory statutory provisions of the country in which the consumer is habitually resident.

The place of performance for services arising from contractual relationships with business customers is the registered office of Alma-Park GmbH.

The courts at Alma-Park GmbH’s registered office have jurisdiction where the contracting party is a merchant, a legal entity governed by public law or a special fund governed by public law.

The same applies, insofar as permitted by law, where the contracting party has no general place of jurisdiction in Germany or their domicile or habitual residence is unknown when proceedings are brought.

Alma Park’s right to bring proceedings before a competent court at another statutory place of jurisdiction remains unaffected.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

8.5 Partial invalidity

If any provision of these General Terms and Conditions is or becomes wholly or partly invalid or unenforceable, the validity of the remaining provisions remains unaffected.

The statutory provisions apply in place of any invalid or unenforceable provision.

The same applies to any unintended gaps in the provisions.
